When opening a bar tab, Nocturne Teas may require a card pre-authorization to verify payment validity.

When Pre-Authorization May Be Used

Pre-authorization practices may vary depending on operational needs. While we do not always pre-authorize every tab, we reserve the right to do so at any time, including but not limited to the following circumstances:

• During large events or high-traffic periods, when there is an increased risk of unpaid tabs

• For large groups or parties, particularly when one individual intends to pay for multiple guests

• On a case-by-case basis, based on prior experiences related to tab closure or payment completion from a particular guest

• During periods when we temporarily or permanently reinstate broader pre-authorization practices for operational or security reasons

The decision to pre-authorize a tab is made solely to ensure smooth service, reduce unpaid tabs, and protect both guests and staff.

Important Notes About Pre-Authorization

• A temporary hold may appear on your account, typically between $0.01 and $3.00 but it may be up to $250.00 for large parties. If the pre-authorization amount exceeds $10.00 you will be informed prior to the pre-authorization. You may also request to know the pre-authorization amount prior to providing your card for the pre-authorization.

• This is not a charge

• The hold will automatically adjust to your final bill total when the tab is closed

• If a tab is not closed manually, it will be closed by staff at the end of the business day, in this event, the staff are authorized to add a gratuity of up to 20% of the unpaid tab, by allowing your card to be pre-authorized you are consenting to this gratuity

• Release timing for unused holds is determined by your financial institution; delays should be directed to your bank, as processing times vary

Why This Policy Exists

Pre-authorization helps reduce card fraud, prevent unpaid tabs, and ensure efficient service—especially during busy or high-risk periods—while allowing us flexibility to adapt to changing conditions.

All open tabs are expected to be paid in full before leaving the premises.

• If a guest departs without closing a tab, the pre-authorized card on file will be charged for the full balance plus any outstanding gratuity—all tabs walked out on will automatically have a 20% gratuity applied.

• If the card on file declines, the account holder will be contacted and given 24 hours to complete payment.

• Failure to resolve payment within 24 hours may result in a service ban and may be subject to a collection process.

Walkouts directly affect our staff, who depend on tips and accurate sales reporting—thank you for your understanding and honesty.

This policy is also publicly posted throughout our establishment, including directly in front of our register and card terminal. By entering our establishment and opening a bar-tab you are agreeing to the terms of this policy. If you do not wish to be subject to the terms of this policy please pay for your items immediacy upon receipt.

At Nocturne Teas, we want every guest to leave satisfied. While most of our products are perishable and cannot be returned once served, we handle all concerns with fairness and common sense.

If you’re unhappy with a purchase for any reason:

• Please speak with a bartender or manager right away. In most cases, we will replace your drink or product, provide a store credit, or issue a refund.

• Our refund policy does not apply to items and food that is damaged or destroyed through intentional acts of malice by the end user.

We believe in resolving issues kindly, promptly, and respectfully — please don’t hesitate to let us know if something isn’t right.

• We welcome outside food and drinks, however alcohol IS NOT PERMITTED on or near our premises. Any guest found bringing or consuming alcohol on or near the premises will be asked to leave.

• Smoking or vaping cannabis (including THC, delta-8, or similar substances) is not permitted anywhere on our property — indoors, on the patio, or in the parking lot. This includes any device or product that emits a noticeable cannabis odor.

• Tobacco products and nicotine vapes are allowed only in designated outdoor areas.

• Illegal drugs are not permitted on or near the premises.

• We reserve the right to refuse service to anyone for behavior that compromises safety, comfort, or the respect of our guests and employees.

Please treat our staff and other guests with respect—our community thrives on good vibes and mutual courtesy.

By participating in The Wheel of Controlled Generosity (“the Wheel”), the customer (“Participant”) acknowledges, understands, and agrees to the following terms and conditions.

1. Acceptance of Policy

Participation in the Wheel constitutes full and unconditional agreement to this policy. If a Participant does not agree to these terms, they must not spin the Wheel.

2. Eligibility and Participation

• Participation is limited to one (1) spin per person per day.

• Spins are offered at the sole discretion of Nocturne Teas.

• No purchase is required, unless otherwise stated at the time of participation.

3. Employee Verification Requirement

• For a spin to be valid, the Participant must initiate the spin in the physical presence of a Nocturne Teas employee, with the Wheel clearly visible to both the Participant and the employee for the entire duration of the spin and result.

• Any spin not witnessed in real time by a Nocturne Teas employee will not be honored, regardless of screenshots, recordings, or claims.

• Employees are the final authority on whether a spin was properly witnessed and valid.

4. Prizes and Awarding

• All prizes are promotional only and have no cash or monetary value.

• Prizes are non-transferable, non-refundable, and may not be exchanged for cash, credit, or any other consideration.

• The awarding, interpretation, substitution, modification, or refusal of any prize is at the sole discretion of Nocturne Teas, including its employees, managers, officers, owners, and representatives.

• Nocturne Teas reserves the right to substitute prizes of equal or lesser value, or to decline to award a prize, if necessary for operational, compliance, or abuse-prevention reasons.

5. Discount Limitations

• Any percentage-based discount applies only to the first $100.00 USD of an order subtotal.

• Any discount applied beyond the first $100.00 is entirely at the sole discretion of Nocturne Teas.

• Discounts may not be stacked with other promotions, discounts, memberships, or offers unless expressly permitted by Nocturne Teas at the time of redemption.

6. Timing and Redemption

• Prizes must be redeemed immediately or within the timeframe specified by Nocturne Teas at the time of the spin.

• Failure to redeem within the permitted timeframe results in forfeiture of the prize.

• No rain checks will be issued.

7. Abuse, Manipulation, and Disqualification

Nocturne Teas reserves the right to deny participation, void spins, revoke prizes, or permanently disqualify any individual who, in the sole judgment of Nocturne Teas:

• Attempts to exceed the daily spin limit

• Attempts to manipulate, exploit, or game the Wheel or its rules

• Provides false information or misrepresents eligibility

• Engages in disruptive, hostile, or inappropriate behavior toward staff or other patrons

• Attempts to argue, coerce, or pressure staff regarding outcomes or interpretations of this policy

8. No Guarantee of Winning

The Wheel is a promotional experience intended for entertainment and engagement.
No outcome is guaranteed, and most spins do not result in a prize. Participation does not create any entitlement or expectation of value.

9. Modification or Termination

Nocturne Teas reserves the right to:

• Modify these terms at any time without prior notice

• Temporarily suspend or permanently discontinue the Wheel

• Adjust odds, prizes, or eligibility criteria

All changes are effective immediately upon posting.

10. Limitation of Liability

To the fullest extent permitted by law, Nocturne Teas shall not be liable for any claims, losses, damages, injuries, or disputes arising out of or related to participation in the Wheel, including but not limited to technical errors, misunderstandings, or perceived unfairness.

11. Governing Law

This policy shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.

1. Groups of three (3) or more:
   All players must have an open bar tab.

   If no queue is present, extended play requires reasonable, ongoing ordering.

   If a queue is present, play is limited to one match per group, and all players must have an open tab.

2. Children under 16 must be accompanied by an adult at all times.

3. No food or drinks permitted on or near the pool table.

4. Pool balls and house cues must be requested from the bartender.
   A valid photo ID or other approved collateral is required and must be left with the bartender while equipment is in use.

5. Pool balls must be returned to the kavatender on shift before collateral is returned.

6. Game time limits & queueing:

   If no group is waiting, games are not time-limited.

   If there is a queue, play is limited to one match per group.

   The queue is managed using the whiteboard located near the pool table.

7. Gameplay rules default to APA rules, unless all players in the current match agree otherwise.

8. Only blue chalk may be used.
   If chalk is needed and none is available in the pool area, please ask the bartender.

9. Hand chalk may be used, but players must make a reasonable effort to avoid getting chalk on the felt.
   If chalk contacts the felt, players are expected to brush the felt after finishing play.

10. No jump shots or massé shots.

11. Do not sit on or move the pool table.
    The pool table area is monitored by audio and video surveillance.

12. Damage & responsibility:

13. Players who damage pool equipment are required to report it immediately to an employee.

14. Players who break pool cues due to negligence may be financially responsible for replacement.

15. Normal wear is expected: detachment of the leather cue tip (the tip that contacts the cue ball) does not constitute breakage and is understood to occur through regular use.

16. Respect the equipment and the space.

    Failure to follow these rules may result in suspension of pool privileges for a period determined by management.

To support staffing, service, entertainment, and the additional operating costs associated with large orders and special events, Nocturne Teas applies the following service charges:

Large-Order Service Charge

An 18% automatic service charge will be applied to orders with a pre-tax subtotal greater than $60, after discounts and excluding gift-card purchases.

Special-Event Service Charge

A 15% automatic event service charge will be applied to purchases made during designated special events. These events may include live music, raves, DJ events, holiday events, ticketed programming, and other specially announced entertainment.

When an event service charge is in effect, notice will be posted at the entrance, ordering area, menu, event listing, or other conspicuous location before purchases are made.

How the Charges Apply

The large-order and event service charges will not be combined. When the 15% event service charge is in effect, it replaces the 18% large-order service charge, regardless of the order total.

Service charges are mandatory and will appear as a separate line on the customer’s tab or receipt. They are not voluntary gratuities. Any additional gratuity is optional and always appreciated.
