Welcome to Nocturne Teas. Our goal is to provide an enjoyable, safe, and respectful environment for all guests. The following policies outline our customer terms regarding payment, conduct, and services. By visiting our establishment, making a purchase, or opening a tab, you agree to these policies.

When opening a tab, Nocturne Teas requires a card pre-authorization to verify payment validity.
A temporary hold may appear on your account for a set amount (between $0.01 and $3.00).
This is not a charge. The hold automatically adjusts to your final bill total when the tab is closed.
If your tab is not closed manually at the bar, it will be closed by an employee at the end of the business day.
If your bank takes longer to release the unused portion of the hold, please contact them directly—processing times vary by institution.
This process protects both guests and staff by reducing card fraud and ensuring efficient service during busy hours.

All open tabs are expected to be paid in full before leaving the premises.
If a guest departs without closing a tab, the pre-authorized card on file will be charged for the full balance plus any outstanding gratuity—all tabs walked out on will automatically have a 20% gratuity applied.
If the card on file declines, the account holder will be contacted and given 24 hours to complete payment.
Failure to resolve payment within 24 hours may result in a service ban and may be subject to a collection process.
Walkouts directly affect our staff, who depend on tips and accurate sales reporting—thank you for your understanding and honesty.
This policy is also publicly posted throughout our establishment, including directly in front of our register and card terminal. By entering our establishment and opening a bar-tab you are agreeing to the terms of this policy. If you do not wish to be subject to the terms of this policy please pay for your items immediacy upon receipt.

At Nocturne Teas, we want every guest to leave satisfied. While most of our products are perishable and cannot be returned once served, we handle all concerns with fairness and common sense.
If you’re unhappy with a purchase for any reason:
Please speak with a bartender or manager right away. In most cases, we will replace your drink or product, provide a store credit, or issue a refund.
Our refund policy does not apply to items and food that is damaged or destroyed through intentional acts of malice by the end user.
We believe in resolving issues kindly, promptly, and respectfully — please don’t hesitate to let us know if something isn’t right.

Item descriptionNocturne Teas gift cards are treated like cash and cannot be replaced if lost or stolen.
Gift cards cannot be redeemed for cash except as required by Florida law.
Balances never expire and can be used for drinks, retail merchandise, or events.

We want all guests to enjoy themselves while maintaining a welcoming environment.
Disruptive, aggressive, or intoxicated behavior may result in removal from the premises up to the extent of being permanently trespassed from the property.
We welcome outside food and drinks, however alcohol IS NOT PERMITTED on or near our premises. Any guest found bringing or consuming alcohol on or near the premises will be asked to leave.
Smoking or vaping cannabis (including THC, delta-8, or similar substances) is not permitted anywhere on our property — indoors, on the patio, or in the parking lot. This includes any device or product that emits a noticeable cannabis odor.
Tobacco products and nicotine vapes are allowed only in designated outdoor areas.
Illegal drugs are not permitted on or near the premises.
We reserve the right to refuse service to anyone for behavior that compromises safety, comfort, or the respect of our guests and employees.
Please treat our staff and other guests with respect—our community thrives on good vibes and mutual courtesy.

By participating in The Wheel of Controlled Generosity (“the Wheel”), the customer (“Participant”) acknowledges, understands, and agrees to the following terms and conditions.
1. Acceptance of Policy
Participation in the Wheel constitutes full and unconditional agreement to this policy. If a Participant does not agree to these terms, they must not spin the Wheel.
2. Eligibility and Participation
Participation is limited to one (1) spin per person per day.
Spins are offered at the sole discretion of Nocturne Teas.
No purchase is required, unless otherwise stated at the time of participation.
3. Employee Verification Requirement
For a spin to be valid, the Participant must initiate the spin in the physical presence of a Nocturne Teas employee, with the Wheel clearly visible to both the Participant and the employee for the entire duration of the spin and result.
Any spin not witnessed in real time by a Nocturne Teas employee will not be honored, regardless of screenshots, recordings, or claims.
Employees are the final authority on whether a spin was properly witnessed and valid.
4. Prizes and Awarding
All prizes are promotional only and have no cash or monetary value.
Prizes are non-transferable, non-refundable, and may not be exchanged for cash, credit, or any other consideration.
The awarding, interpretation, substitution, modification, or refusal of any prize is at the sole discretion of Nocturne Teas, including its employees, managers, officers, owners, and representatives.
Nocturne Teas reserves the right to substitute prizes of equal or lesser value, or to decline to award a prize, if necessary for operational, compliance, or abuse-prevention reasons.
5. Discount Limitations
Any percentage-based discount applies only to the first $100.00 USD of an order subtotal.
Any discount applied beyond the first $100.00 is entirely at the sole discretion of Nocturne Teas.
Discounts may not be stacked with other promotions, discounts, memberships, or offers unless expressly permitted by Nocturne Teas at the time of redemption.
6. Timing and Redemption
Prizes must be redeemed immediately or within the timeframe specified by Nocturne Teas at the time of the spin.
Failure to redeem within the permitted timeframe results in forfeiture of the prize.
No rain checks will be issued.
7. Abuse, Manipulation, and Disqualification
Nocturne Teas reserves the right to deny participation, void spins, revoke prizes, or permanently disqualify any individual who, in the sole judgment of Nocturne Teas:
Attempts to exceed the daily spin limit
Attempts to manipulate, exploit, or game the Wheel or its rules
Provides false information or misrepresents eligibility
Engages in disruptive, hostile, or inappropriate behavior toward staff or other patrons
Attempts to argue, coerce, or pressure staff regarding outcomes or interpretations of this policy
8. No Guarantee of Winning
The Wheel is a promotional experience intended for entertainment and engagement.
No outcome is guaranteed, and most spins do not result in a prize. Participation does not create any entitlement or expectation of value.9. Modification or Termination
Nocturne Teas reserves the right to:
Modify these terms at any time without prior notice
Temporarily suspend or permanently discontinue the Wheel
Adjust odds, prizes, or eligibility criteria
All changes are effective immediately upon posting.
10. Limitation of Liability
To the fullest extent permitted by law, Nocturne Teas shall not be liable for any claims, losses, damages, injuries, or disputes arising out of or related to participation in the Wheel, including but not limited to technical errors, misunderstandings, or perceived unfairness.
11. Governing Law
This policy shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.
